We warrant and represent to you that throughout the Term:
We have legal capacity, power and authority to enter into and perform these Terms; and
We have all rights in relation to the Products and to perform our obligations as set out in these Terms.
We warrant that the Products will be shipped to you with a shelf life of 12 months or more, (Product Warranty).
Exchange & Refunds
We do not provide exchanges, credit notes or refunds for change of mind or short-dated stock that the retailer failed to sell through in a timely manner.
You must notify our customer care team at firstname.lastname@example.org or 09 415 6757 of: - any incomplete delivery; - shortage of or damage to Products; - any claims against the Product Warranty due to nonconformities or defects which can be identified by inspection, within 3 business days of receipt of the shipment. To the extent not prohibited by law, you waive your rights if you fail to do so. Our customer care will inform you of any further information we require prior to providing an exchange, credit note or refund, and we will offer you an exchange, credit note or refund at our discretion.
To the extent not prohibited by law, we will not exchange or refund any Products which have a shelf life of less than 12 months.
